In November 2009 Kiran Bhogal, the Head of the Healthcare Advisory Department at Weightmans, acted for an NHS Trust in the "tug of love" case of Baby RB. The mother of the seriously disabled little boy agreed with doctors that his life support machine should be switched off but his father was against it. Six days into the High Court hearing, having heard evidence from health experts that his one-year-old son's condition would never improve, the father conceded the action was in the child's best interest. The little boy had an extremely rare genetic condition, affecting all of the muscles in his body, but it did not affect his brain, so he could see, hear, and feel the necessary painful long-term treatment. Had the father not agreed, it would have been the first time a British court had, against the will of a parent, determined that life support could be withdrawn from a child who was not suffering brain damage. Kiran is also a Deputy District Judge. |
